Why Houston Rideshare Cases Are Different From Other Car Wrecks

A rideshare wreck involves more parties, more policies, and more moving pieces than a standard car accident. The driver has personal coverage. Uber and Lyft each carry commercial policies that may apply depending on what the driver’s app was doing at the moment of impact. Other drivers may have been involved. And the rideshare company’s own commercial carrier has a financial interest in characterizing the wreck in whichever way reduces what they have to pay.

Texas Insurance Code Section 1954.052 set up a three-phase framework that governs which coverage applies. App off, only the driver’s personal policy applies. App on but no ride accepted, Uber or Lyft provide contingent coverage that’s higher than Texas state minimums. Trip accepted or passenger in the car, the full commercial policy of $1 million in liability plus $1 million in uninsured and underinsured motorist coverage kicks in. The phase question alone can be the difference between a state-minimum settlement and a real recovery.

For example, a potential Houston rideshare passenger might be hit when their Uber driver runs a red light at the I-69 frontage road. The driver’s personal carrier denies the claim because the driver was working. Uber’s commercial carrier tries to argue the trip had technically ended. Without someone digging into the app data, that passenger might never see the $1 million policy that should have been in play.
